1. Parties
These terms govern the relationship between you (the “client”) and EkoVault Atelier Sdn Bhd, a private limited company registered in Malaysia under company number 202101038657 (1432708-K), with its principal place of business at Lot 18-G, Jalan PJU 5/20, The Strand, Kota Damansara, 47810 Petaling Jaya, Selangor.
2. How a commission begins
A commission becomes binding only when (a) we have issued a written quote referencing the agreed scope, timber and timeline; (b) you have signed and returned the quote acknowledgement; and (c) we have received the agreed deposit. Until all three are in place, nothing is committed on either side.
3. Deposits and payment schedule
For furniture and storage commissions, the standard schedule is 50% deposit on signature, 40% on completion of bench work (we send photographs), and the remaining 10% on installation and acceptance. For commercial fit-outs, the schedule is agreed on a per-project basis and is set out in the quote.
All amounts are quoted in Malaysian Ringgit (MYR) inclusive of SST where applicable. Payments are made by interbank transfer or to our DuitNow Business QR; we do not accept cash for commissions above RM 5,000.
4. Timber selection and substitution
The quote identifies the species, grade and provenance of the timber to be used. If a specific batch becomes unavailable during build (rare but it does happen — particularly with figured boards), we will write to you with the proposed substitute species or batch before proceeding. You may either accept, decline, or pause the build. We will not substitute timber without your written consent.
5. Lead times
Lead times stated in the quote are working estimates, calculated against our current bench load at the time of signature. We aim to hit the stated installation date within seven working days either way. Genuinely exceptional delays (an act of nature, raw timber supplier failure, illness in a small studio) are communicated immediately with revised dates.
6. Changes during the build
Once cutting begins, design changes that affect timber, dimensions or hardware are absorbed only if they are minor and uncomplicated. Larger changes are quoted as a variation. We will always tell you, in writing, before incurring any chargeable variation work.
7. Delivery and installation
Delivery to addresses within the Klang Valley is included in the quoted price. Delivery to other Peninsular Malaysian addresses is quoted as a line item. East Malaysian deliveries include sea-freight and the use of an established install partner. Risk passes to the client on signed acceptance after installation.
8. Warranty
Structural joinery on all freestanding furniture and built-in storage is warranted for ten (10) years from delivery against failure under normal residential use. Commercial fit-outs carry a two (2) year operator warranty. Surface finishes are warranted for two (2) years; routine re-oiling at the three-year point is expected and is not a warranty matter.
The warranty does not cover damage from misuse, accidents, modifications made without our knowledge, exposure to direct daily sunlight, or extreme humidity environments outside the residential norm.
9. Settling visit
Every residential commission includes a complimentary six-month settling visit during which we re-tune drawer runs, door alignment and any seasonal movement. The visit is scheduled by us at month five and confirmed with you for a date that works.
10. Cancellation
You may cancel a commission up to seven days after deposit, with a full refund less an administration fee of RM 350. After timber has been purchased and cutting has begun, the deposit is retained against work already done; we will provide a written reconciliation. If we cancel a commission ourselves (rare, but reserved for the case where we conclude we cannot deliver the piece to our standard), you receive a full refund.
11. Intellectual property
Designs we produce for your commission are co-owned. You are free to use the design in your own home or business indefinitely. We retain the right to photograph the finished piece (subject to your consent) and to reproduce the design for another commission with non-identifying changes.
12. Limitation of liability
Our maximum liability under any commission is limited to the amount actually paid to us under that commission, except in cases of death or personal injury caused by our negligence, which are not limited as required by Malaysian law.
13. Governing law
These terms are governed by the laws of Malaysia. Disputes that cannot be resolved by mediation in good faith will fall under the non-exclusive jurisdiction of the courts of Kuala Lumpur.
